Where is surcharging allowed?

Surcharging is legal in 46 states, so make sure you're legally allowed to surcharge before doing so.

Most states allow for the practice of surcharging credit cards. There are a few hold-outs. In particular, you are not allowed to surcharge credit card transactions in the following four states:

  • Colorado

  • Connecticut

  • Kansas

  • Massachusetts
